Kyosei, a traditional Japanese concept, has been applied to a variety subjects, from biology to business. It has more recently become synonymous with the concepts of corporate responsibility, ethical decision making, stakeholder maximization, and responsible reciprocity. The purpose of this paper is to trace kyosei's modern business application back to ancient Confucian thought. The ideals associated with Confucianism were instrumental in the creation of Japanese business codes of ethics during the early part of the seventeenth century. A short history of (...) this period is presented to provide a contextual framework for understanding these codes. A specific code of ethics, called the shuchu kiyaku, is presented for the first time in English and shown to have direct roots in Confucian writings. Statements from modern company codes and from modern Japanese and American businessmen are presented to reflect the philosophy of business embodied in that ancient code of ethics. (shrink)

Dialogues generated over a year of weekly meetings with 8 children at a school in Edinburgh. The author and the children attempted to craft stories reflecting philosophical problems.

We report on an interview-based study of decision-making capacity in two classes of patients suffering from depression. Developing a method of second-person hermeneutic phenomenology, we articulate the distinctive combination of temporal agility and temporal inability characteristic of the experience of severely depressed patients. We argue that a cluster of decision-specific temporal abilities is a critical element of decision-making capacity, and we show that loss of these abilities is a risk factor distinguishing severely depressed patients from mildly/moderately depressed patients. With the waves of reform occurring in mental health legislation in England and other jurisdictions, mental capacity is set to become a key medico-legal concept. The concept is central to the law of informed consent and is closely aligned to the philosophical concept of autonomy. It is also closely related to mental disorder. This paper explores the interdisciplinary terrain where mental capacity is located. Our aim is to identify core dilemmas and to suggest pathways for future interdisciplinary research. The terrain (...) can be separated into three types of discussion: philosophical, legal and psychiatric. Each discussion approaches mental capacity and judgmental autonomy from a different perspective yet each discussion struggles over two key dilemmas: whether mental capacity and autonomy is/should be a moral or a psychological notion and whether rationality is the key constitutive factor. We suggest that further theoretical work will have to be interdisciplinary and that this work offers an opportunity for the law to enrich its interpretation of mental capacity, for psychiatry to clarify the normative elements latent in its concepts and for philosophy to advance understanding of autonomy through the study of decisional dysfunction. The new pressures on medical and legal practice to be more explicit about mental capacity make this work a priority. (shrink)

In “Tracking, Competence, and Knowledge,” Ernest Sosa notes that in attempting to account for the conditions for knowledge, externalists have proposed that the justification condition be replaced or supplemented by the requirement that a certain modal relation be obtained between a fact and a subject's belief concerning that fact. While assessing attempts to identify such a relation, he focuses on an account labeled “Cartesian‐tracking”, which accounts for the relation in the form of two conditionals. If a person S believes (...) a proposition P → P P → S believes P. Sosa suggests that be abandoned as a requirement, and that, equipped with his modifications, can offer promising results in connection with skepticism. He argues that modified coupled with the requirement that S's belief be “virtuous” can illuminate the nature of propositional knowledge. (shrink)

Ernest Gellner's final book, first published in 1998, is a synoptic interpretation of the thought of Wittgenstein and Malinowski.

Ernest Gellner made major contributions in very diverse fields, notably philosophy and social anthropology. His attacks on the orthodoxies of his time made it difficult for him to be fully accepted into either of these academic communities, but that suited him well enough: he seemed to enjoy leading a one-man crusade for critical rationalism, defending enlightenment universalism against the rising tides of idealism and relativism. His influence spread far beyond social anthropology: the fierce tone of the polemics of the (...) 1950s against Oxford philosophers was repeated during the 1990s in tangles in the TLS with the literary critic Edward Said. For Gellner the issues were essentially the same: the vital need to refute the claim that ideas lead the world. (shrink)

Assessment of decision-making capacity (DMC) can be difficult in acquired brain injury (ABI) particularly with the syndrome of organic personality disorder (OPD) (the “frontal lobe syndrome”). Clinical neuroscience may help but there are challenges translating its constructs to the decision-making abilities considered relevant by law and ethics. An in-depth interview study of DMC in OPD was undertaken. Six patients were purposefully sampled and rich interview data were acquired for scrutiny using interpretative phenomenological analysis. Interview data revealed that awareness of deficit (...) and thinking about psychological states can be present. However, the awareness of deficit may not be “online” and effectively integrated into decision-making. Without this online awareness of deficit the ability to appreciate or use and weigh information in the process of deciding some matters appeared absent. We argue that the decision-making abilities discussed are: (1) necessary for DMC, (2) threatened by ABI, and (3) assessable at interview. Some advice for practically incorporating these abilities within assessments of DMC in patients with OPD is outlined. (shrink)

We found much to agree with and it is striking how so many of the issues relating to decision-making capacity assessment find resonances outside of an English jurisdiction. Theoria, EarlyView. -/- In his recent book Thin Objects, Øystein Linnebo (2018) argues for the existence of a hierarchy of abstract objects, sufficient to model ZFC, via a novel and highly interesting argument that relies on a process called dynamic abstraction. This paper presents a way for a nominalist, someone opposed to the existence of abstract objects, to avoid Linnebo's conclusion by rejecting his claim that certain abstraction principles are sufficient for reference (RBA). Section 1 of the paper explains Linnebo's (...) argument for RBA. It offers a reading of Linnebo's work upon which he has two arguments for RBA: one deductive and one abductive, and argues that whilst the deductive argument is unsound the abductive one is prima facie plausible. The nominalist must therefore find a way to respond to the abductive argument. Section 2 outlines just such a response, by offering an alternative explanation of the cases Linnebo wishes to argue from. Most interestingly, it shows that abstraction in Linnebo's most difficult case (the “reference to ordinary bodies” case) can be achieved using mereological means, rather than relying on RBA. This paper defends an orthodox model of the linguistic intuitions which form a central source of evidence for generative grammars. According to this orthodox conception, linguistic intuitions are the upshot of a system of grammatical competence as it interacts with performance systems for perceiving and articulating language. So conceived, probing speakers’ linguistic intuitions allows us to investigate the competence–performance distinction empirically, so as to determine the grammars that speakers are competent in. This model has been attacked by Michael Devitt in (...) his recent book and a series of papers. In its place, Devitt advances a model of linguistic intuitions whereby they are speakers’ theory-laden judgements about the properties of languages. Bertrand Russell, in the second of his 1914 Lowell lectures, Our Knowledge of the External World, asserted famously that ‘every philosophical problem, when it is subjected to the necessary analysis and purification, is found either to be not really philosophical at all, or else to be, in the sense in which we are using the word, logical’ (Russell 1993, p. 42). He went on to characterize that portion of logic that concerned the study of forms of propositions, or, as he (...) called them, ‘logical forms’. This portion of logic he called ‘philosophical logic’. Russell asserted that ... some kind of knowledge of logical forms, though with most people it is not explicit, is involved in all understanding of discourse. It is the business of philosophical logic to extract this knowledge from its concrete integuments, and to render it explicit and pure. (p. 53) Perhaps no one still endorses quite this grand a view of the role of logic and the investigation of logical form in philosophy. But talk of logical form retains a central role in analytic philosophy. Given its widespread use in philosophy and linguistics, it is rather surprising that the concept of logical form has not received more attention by philosophers than it has. The concern of this paper is to say something about what talk of logical form comes to, in a tradition that stretches back to (and arguably beyond) Russell’s use of that expression. This will not be exactly Russell’s conception. For we do not endorse Russell’s view that propositions are the bearers of logical form, or that appeal to propositions adds anything to our understanding of what talk of logical form comes to. But we will be concerned to provide an account responsive to the interests expressed by Russell in the above quotations, though one clarified of extraneous elements, and expressed precisely. For this purpose, it is important to note that the concern expressed by Russell in the above passages, as the surrounding text makes clear, is a concern not just with logic conceived narrowly as the study of logical terms, but with propositional form more generally, which includes, e.g., such features as those that correspond to the number of argument places in a propositional function, and the categories of objects which propositional.... Extends the ideas of social constructivism to the philosophy of mathematics, developing a powerful critique of traditional absolutist conceptions of mathematics, and proposing a reconceptualization of the philosophy of mathematics.

In a recent paper, Jc Beall has employed what he calls ‘shriek rules’ in a putative solution to the long-standing ‘just false’ problem for glut theory. The purpose of this paper is twofold: firstly, I distinguish the ‘just false’ problem from another problem, with which it is often conflated, which I will call the ‘exclusion problem’. Secondly, I argue that shriek rules do not help glut theorists with either problem.

SUMMARYThe nineteenth-century Orientalist and ethnologist, John Crawfurd, publicly rejected Charles Darwin’s theory of evolution in 1868. Crawfurd was a leading advocate of polygenesis but also a supporter of racial equality. In 1820 he published his History of the Indian Archipelago, where he advocated granting household suffrage to all races in the British colonies. After finishing a career in the East India Company in 1828 he became the foremost expert on South-East Asia in Britain. Crawfurd became a regular writer on ethnology (...) and Asian affairs for the Examiner newspaper and in the 1860s he was President of the Ethnological Society of London. Accounts of nineteenth-century anthropology in Britain characterise debate around race as falling into two camps: advocates of monogenesis and advocates of polygenesis. In the United States of America, advocates of polygenesis were often associated with advocates of slavery and racial inequality. Recent research has demonstrated that Charles Darwin’s hatred of slavery drove him to write Origin of the Species to demonstrate the unity of the human species and reject the polygenesis position. This paper explores Crawfurd’s ideas and demonstrates that a belief in polygenesis in the nineteenth century did not necessarily equate with a belief in racial inequality. (shrink)

This chapter takes up, in six sections, issues of realism and of ontological and conceptual relativity. Section 1 briefly lays out the kind of absolutist realism of interest in what follows. Section 2 considers arguments against ordinary commonsense entities such as bodies, and for the view that subjects enjoy a superior ontological position. No such argument is found persuasive. I find no good argument against ordinary bodies or other common-sense entities, nor any good argument that subjects enjoy any ontological superiority. (...) Section 3 lays out three options in ontology, opts for a kind of conceptual relativism, and takes up three problems for the proposed view. Section 4 then offers a compromise position based on a kind of existential relativity meant to accommodate our most settled beliefs about what there is, while retaining a fundamentally realist and objectivist ontology. The main argument of that section relies on a distinction between semantical relativity and ontological relativity. Section 5 defends my use of the semantical-ontological distinction against objections to it in the recent literature. Section 6, in conclusion, takes up arguments for the view that, as subjects of consciousness and thought, we must after all occupy a special ontological position in objective reality, one whose status remains mysterious.
